General terms and conditions of sales
These General Terms and Conditions of Sale (hereinafter "Terms") apply to all bookings and transactions made with Château de la Rochetière, operated by SILA Rochetière SAS. They govern the rental of guest room(s) in bed-and-breakfast format and the private rental of the château as a self-catering property (gîte). By completing a booking, the guest acknowledges having read these Terms in full and agrees to comply with them.
Article 1 – Types of Accommodation
1.1 Guest Room(s) — Bed-and-Breakfast Format
The booking covers one or more individual guest rooms within the property. Common areas (lounge, breakfast room, grounds) are shared with other guests. The capacity and configuration of each room are specified at the time of booking.
1.2 Private Château Rental — Exclusive Use
The booking covers the entire château and its accessible outbuildings, for a maximum of 13 persons including adults and children. Certain private, technical, storage or staff-only areas remain excluded from the rental even in the case of full privatisation. Access to such areas is strictly prohibited unless expressly authorised by the establishment.
Any persons present on the premises who were not declared at the time of booking are strictly prohibited. A surcharge of €150 per undeclared person per night may be applied, and the stay may be terminated immediately without refund.
The private château rental is exclusively reserved for the use of the booking group. The organisation of parties, public events or any gathering involving persons outside the booking group is strictly prohibited and constitutes grounds for immediate termination of the stay.
Article 2 – Booking and Advance Payment
2.1 Booking Procedure
To make a booking, the guest must provide accurate and complete information: personal contact details, dates of stay, number of persons and group composition for château rental bookings. Any false declaration shall engage the guest's liability.
A booking is confirmed only upon receipt of a confirmation email from the establishment. If no confirmation email is received, the guest should contact the establishment at +33 6 68 56 23 00 or [email protected].
2.2 Right of Withdrawal
Pursuant to Article L221-28(12°) of the French Consumer Code, the 14-day right of withdrawal applicable to distance contracts does not apply to accommodation services booked for specific dates. No right of withdrawal may therefore be exercised once the booking has been confirmed. The cancellation conditions set out in Article 6 apply.
2.3 Advance Payment
All bookings require the payment of an advance deposit of 50% of the total stay amount (excluding tourist tax and ancillary services). This amount is charged directly to the guest's payment card at the time of booking confirmation. This is a direct charge, not a pre-authorisation: the amount is immediately collected.
The remaining balance of 50% is due no later than the day of arrival, in accordance with the payment methods accepted by the establishment.
The advance payment and the balance together constitute payment of the stay price. They are entirely separate from the security deposit provided for in Article 5, which is governed by its own rules and may not under any circumstances be applied towards the cost of the stay.
The advance payment constitutes a binding contractual commitment and not a preliminary deposit entitling either party to withdraw from the agreement upon forfeiture. The contract is firm upon receipt of the advance payment, and the cancellation conditions of Article 6 apply in full.
2.4 Bookings via Third-Party Platforms and Organisations
Bookings made through online booking platforms (Booking.com, Airbnb, Gîtes de France or any other third party) are subject to these Terms, subject to any specific conditions of the relevant platform regarding payment, cancellation or refund, which may prevail on those specific points.
Rules relating to occupancy of the premises, maximum capacity, noise restrictions, prohibition of parties, non-smoking policy, pets, safety and care of furnishings apply in all cases, regardless of the booking platform used.
Bookings made directly with a company in the context of a seminar or privatisation event are governed by a separate quotation and service agreement, which takes precedence over these Terms for the matters it covers.
Article 3 – Check-In and Check-Out
Check-in : Room(s) : from 4:00 PM | Château rental : from 6:00 PM
Check-out : Room(s) : before 11:00 AM | Château rental : before 11:00 AM
Early check-in or late check-out may be granted upon request, subject to availability and prior agreement with the establishment; additional charges may apply.
Failure to vacate the premises by 11:00 AM without prior arrangement may result in the charge of an additional night at the applicable rate.
Article 4 – Rates, Payment and Tourist Tax
4.1 Rates
Rates are quoted per night for the number of persons indicated. Breakfast is included in the bed-and-breakfast format. End-of-stay cleaning is included in both room and château rental rates. Ancillary services (dinner at the château, spa, massages, pets, electric vehicle charging…) are charged as supplements, as specified at the time of booking or upon request.
4.2 Tourist Tax
In accordance with applicable regulations, a tourist tax (taxe de séjour) is collected upon arrival. The applicable rate is set by the relevant local authority and communicated to the guest at the time of booking or upon arrival. It is payable by all guests aged 18 and over and is not included in the advertised rates.
4.3 Payment Methods
Payment is accepted in accordance with the arrangements agreed at the time of booking, using any of the following methods:
– Credit or debit card (direct charge or payment terminal).
– Bank cheque (chèque bancaire).
– ANCV holiday vouchers (Chèques-Vacances).
– Bank transfer.
– Cash.
Any payment made by cheque, whether for the stay or the security deposit, must be accompanied by a valid official photo ID of the cheque holder.
4.4 Minors
Minors must be accompanied by a legally responsible adult throughout the entire stay. The establishment reserves the right to refuse any booking or stay involving an unaccompanied minor.
Article 5 – Security Deposit
A security deposit is required on the day of arrival, according to the following terms depending on the type of accommodation:
5.1 Guest Room(s)
The security deposit is €300, taken by bank pre-authorisation on the signing guest's payment card on the day of arrival.
5.2 Private Château Rental
The security deposit is €5,000, structured as follows:
– €2,000 by bank pre-authorisation on the signing guest's payment card, on the day of arrival.
– €3,000 by bank cheque or any other payment method accepted by the establishment, provided no later than the day of arrival.
5.3 Nature of the Security Deposit
The security deposit does not constitute an advance payment, a payment towards the stay, or a pre-payment of any part of the price. It is solely intended to guarantee the establishment against potential damages, missing items or charges attributable to the guest. It may not under any circumstances be offset against the cost of the stay or any other sum due under the booking.
5.4 Identity Documents Required for Château Rental
For all private château rentals, the signing guest must present the following documents upon arrival, in addition to the security deposit:
– A valid official photo ID (national identity card, passport or valid residence permit).
– Proof of address dated within the last 3 months (utility bill, landline phone bill, bank statement or tax notice).
These documents are collected solely for the purpose of identifying the signing guest and securing the deposit. They are processed in accordance with Article 12 of these Terms regarding the protection of personal data. Failure to provide these documents entitles the establishment to refuse access to the premises under the conditions set out in Article 5.6.
5.5 Pre-Authorisation Failure
In the event that the bank pre-authorisation fails on the day of arrival (insufficient funds, card blocked, incompatible card type, etc.), the establishment will invite the guest to regularise the situation using one of the following alternatives: a different payment card, a bank transfer, a bank cheque, or any other means accepted by the establishment.
If the situation cannot be resolved within a reasonable time as assessed by the establishment, access to the premises may be refused. Such refusal, arising from the inability to secure the deposit, does not constitute a cancellation attributable to the establishment and does not entitle the guest to a refund of the advance payment.
5.6 Release of the Security Deposit
In the absence of damages, missing items, outstanding charges or breach of these Terms identified at check-out, the establishment will request the release of the pre-authorisation and, where applicable, return any collected amounts within 1 to 2 business days of departure.
The effective timeline for releasing the pre-authorisation depends on the guest's banking institution and may vary between banks; this is beyond the control of Château de la Rochetière and may take up to 30 days from the date the release is requested.
Pre-authorisations cannot be processed on virtual cards issued by online travel agencies (OTAs). An alternative guarantee arrangement will be agreed with the establishment prior to arrival in such cases.
5.7 Check-In and Check-Out Inspection
For all château rentals, a joint inspection of the premises is carried out upon arrival and departure, in the presence of the guest or their representative, and signed by both parties. An inventory of furniture and equipment is appended. If no written objection is raised within 24 hours of key handover, the check-in inspection report is deemed accepted.
For guest rooms, the condition of the room is assessed by the establishment's team upon arrival and departure.
5.8 Deductions and Guest Liability
In the event of damages, missing items or charges identified at check-out, all or part of the security deposit may be withheld, in proportion to the documented loss. The security deposit does not constitute a cap on the guest's liability: if the total amount of damages or charges attributable to the guest exceeds the deposit amount, the difference will be invoiced to the signing guest, supported by relevant documentation (quotes, repair or replacement invoices).
Grounds for deduction or additional invoicing include, but are not limited to:
– Stains on bed linen, towels, furniture or floor coverings.
– Breakage, damage or disappearance of equipment, decorative items or furniture.
– Unreturned or undeclared borrowing of items belonging to the establishment.
– Minibar consumption not declared at check-out: any items consumed and not reported will be charged automatically to the payment card used to settle the stay, at the applicable rate displayed in the room. Guests are kindly asked to declare any minibar consumption before departure.
– Exceptional cleaning costs resulting from non-compliant use of the premises.
– Deodorisation costs resulting from a breach of the non-smoking policy.
Article 6 – Cancellation Conditions
All cancellations must be notified in writing to [email protected]. The date of receipt of the email is the date of record.
6.1 Cancellation Policy — Rooms and Château Rental
– Cancellation more than 14 days before the arrival date: no charge — the advance payment is refunded in full.
– Cancellation between 14 and 7 days before the arrival date: 50% of the total stay amount remains due. The advance payment is applied against this amount.
– Cancellation less than 7 days before the arrival date, no-show, or failure to arrive due to circumstances attributable to the guest: 100% of the total stay amount remains due. The advance payment is retained by the establishment; the remaining balance of 50% remains payable and will be recovered by any lawful means.
No refund will be granted for early departure or unconsumed nights, unless expressly agreed in writing by the establishment as an exceptional measure.
6.2 Refunds
Any applicable refunds will be processed within 5 business days to the original payment method.
6.3 Force Majeure
In the event of force majeure within the meaning of Article 1218 of the French Civil Code (an unforeseeable, unavoidable event beyond the control of either party, such as a natural disaster, pandemic, administrative closure or major incident), the parties will seek to agree, where possible, on a postponement of the stay to equivalent dates. If no agreement can be reached, or if performance of the stay becomes permanently impossible, all amounts paid will be refunded, less any services already consumed. No penalty shall apply to either party.
6.4 Cancellation by the Establishment
In the event of cancellation by Château de la Rochetière for a reason other than force majeure (including double-booking or administrative error), the establishment will refund all amounts paid within 5 business days. The guest may additionally seek compensation for proven loss under the applicable provisions of French civil law.
Article 7 – Occupancy, Capacity and House Rules
7.1 Maximum Capacity
The number of occupants must not exceed the number declared at the time of booking, nor the following limits:
– Guest rooms: as specified per room at the time of booking.
– Château rental: strictly 13 persons maximum (adults and children combined), without exception.
Any undeclared excess in occupancy may result in a surcharge of €150 per undeclared person per night, as well as immediate termination of the stay without refund.
7.2 Prohibition of Parties and External Events
The organisation of parties, public gatherings, loud events or any gathering involving persons outside the booking group is prohibited, including during exclusive château rental.
Privatised events (weddings, seminars, celebrations with external guests) are subject to a separate privatisation agreement. Without a signed agreement, no external guests may be accommodated on the premises.
Any breach of this prohibition may result in immediate termination of the stay, without refund or compensation, as well as invoicing of any costs, damages, disturbances or losses incurred. Such amounts may give rise to a total or partial deduction from the security deposit, subject to the provision of supporting documentation or objective evidence.
7.3 Quiet Hours
The peace and tranquillity of the property must be maintained at all times. From 10:00 PM onwards, silence is required throughout the establishment and its grounds, out of respect for other guests and neighbouring residents.
7.4 Care of the Premises and Furnishings
Guests undertake to use all equipment, furniture and installations with care and in accordance with their intended purpose. Any inappropriate use shall engage the guest's liability in accordance with Article 5.
Article 8 – Pets
Pets may be accepted subject to declaration at the time of booking and prior approval from the establishment. The establishment reserves the right to refuse a pet based on its size, behaviour, the number of animals or the nature of the stay.
The presence of a pet entails an additional charge, comprising a daily supplement and, where applicable, an enhanced cleaning fee. Applicable rates are those in force at the time of booking and will be communicated to the guest prior to booking confirmation.
The pet must remain under the constant supervision of its owner and comply with the following conditions:
– Be kept on a lead in all common areas and on the grounds.
– Not be allowed on beds, sofas, armchairs or any other furniture.
– Not cause noise or odour disturbance to other guests.
Any undeclared pet will result in the charge of the applicable supplement. The owner remains solely responsible for any damage, excessive soiling, nuisance or disturbance caused by their pet; any resulting costs may be invoiced in accordance with Article 5.
Article 9 – Non-Smoking Policy
Château de la Rochetière is a fully non-smoking establishment. Smoking of any kind (cigarettes, cigars, e-cigarettes, shisha pipes, etc.) is strictly prohibited in all indoor areas, including guest rooms, bathrooms, corridors, the lounge and all common areas.
Smoking is permitted outdoors, away from windows and doorways, provided it does not disturb other guests and no litter is left behind (cigarette butts, ash, etc.).
Any breach of this policy may result in cleaning, deodorisation and, where necessary, restoration charges, determined in accordance with current rates and the extent of damage identified, without prejudice to a total or partial deduction from the security deposit.
Article 10 – Ancillary Services
10.1 Dinner at the Château
Dinner at Château de la Rochetière is available upon reservation, subject to availability. It is served as a private table per room or per group, according to the arrangement chosen by the establishment. This service is reserved exclusively for guests staying on the premises, unless expressly agreed otherwise, and does not constitute a restaurant service open to the public.
The menu is set by the establishment, taking into account any allergies, intolerances or dietary requirements notified in advance by guests. Guests are required to declare any dietary restrictions or food allergies at the time of booking. In the absence of such prior declaration, the establishment cannot be held responsible for any incident arising from an undisclosed allergen. The establishment complies with allergen information requirements under EU Regulation No. 1169/2011.
Dinner is charged as a supplement and is not included in the price of the stay. Any dinner reservation cancelled less than 48 hours before the meal will be charged at 100% of the amount of the meal booked.
10.2 Spa and Treatments
Access to the spa and massage treatments are ancillary services charged as supplements. Availability and rates are specified at the time of booking or upon request. Use of the spa facilities requires compliance with the hygiene and safety rules displayed on site.
10.3 Electric Vehicle Charging
Electric vehicle charging is a paid ancillary service, subject to availability and the technical specifications of the installation. Applicable rates are communicated by the establishment at the time of booking or upon arrival. Use of the establishment's charging points, sockets or electrical installations without prior agreement is prohibited.
Article 11 – Liability
11.1 Guest Liability
Guests undertake to comply with all rules of the establishment throughout their stay. They are responsible for:
– The cleanliness and condition of the room, the château and all areas used during the stay.
– Any damage caused to the property, furniture or equipment, which will be invoiced in accordance with Article 5.
– The safety of their personal belongings; the establishment accepts no liability for loss, theft or damage.
– Respect for common areas and for other guests staying on the premises.
– Compliance with all applicable safety instructions and proper use of all installations.
11.2 Establishment Liability
Château de la Rochetière undertakes to provide quality services and to make every effort to ensure a pleasant stay. In the event of a problem or complaint, guests are invited to notify the management immediately so that appropriate action may be taken without delay.
The establishment cannot be held liable for incidents or accidents beyond its control, nor for damages caused by guests themselves.
Article 12 – Personal Data Protection
Personal data collected during the booking process (name, contact details, payment information) is processed by SILA Rochetière SAS on the basis of the performance of the accommodation contract (Art. 6(1)(b) GDPR), solely for the purposes of managing the booking, the guest relationship and compliance with legal obligations (guest register, accounting).
For private château rental bookings, the establishment additionally collects a copy of the signing guest's official photo ID and proof of address, solely for identification purposes and to secure the deposit. These documents are retained for the duration necessary to verify the security deposit and are then destroyed, unless a longer retention period is required by law.
Data required for the management of the guest relationship is retained for a maximum period of 3 years from the end of the stay, unless a longer retention period is required by applicable law, in particular in accounting, tax or regulatory matters. Such data is not sold or transferred to third parties, except as required by law.
In accordance with the General Data Protection Regulation (GDPR) and French data protection law, guests have the following rights regarding their data:
– Right of access and rectification.
– Right to erasure (right to be forgotten).
– Right to restriction of processing.
– Right to data portability.
– Right to object to processing.
To exercise any of these rights, guests should submit a request to [email protected]. If a satisfactory response is not received, guests may lodge a complaint with the French data protection authority (CNIL) at www.cnil.fr.
Article 13 – Mediation and Dispute Resolution
In the event of a dispute that cannot be resolved amicably within 60 days of a written complaint from the guest, the guest may refer the matter free of charge to a consumer mediator, in accordance with applicable French consumer law.
The establishment is in the process of joining an accredited consumer mediation scheme. The name and contact details of the competent mediator will be provided to guests upon request at [email protected], once formal membership has been confirmed.
Recourse to mediation is without prejudice to any other legal remedies available to the guest.
Article 14 – General Provisions
14.1 Insurance
The establishment holds the insurance policies required for its activity. Guests are advised to ensure that their personal insurance or travel insurance covers the risks of cancellation, civil liability and property damage during their stay.
14.2 Governing Law and Severability
These Terms are governed by French law. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Acceptance
By completing a booking at Château de la Rochetière, the guest acknowledges having read, understood and accepted these General Terms and Conditions of Sale in their entirety.

5.8 Deductions and Guest Liability
In the event of damages, missing items or charges identified at check-out, all or part of the security deposit may be withheld, in proportion to the documented loss. The security deposit does not constitute a cap on the guest's liability: if the total amount of damages or charges attributable to the guest exceeds the deposit amount, the difference will be invoiced to the signing guest, supported by relevant documentation (quotes, repair or replacement invoices).
Grounds for deduction or additional invoicing include, but are not limited to:
– Stains on bed linen, towels, furniture or floor coverings.
– Breakage, damage or disappearance of equipment, decorative items or furniture.
– Unreturned or undeclared borrowing of items belonging to the establishment.
– Minibar consumption not declared at check-out: any items consumed and not reported will be charged automatically to the payment card used to settle the stay, at the applicable rate displayed in the room. Guests are kindly asked to declare any minibar consumption before departure.
– Exceptional cleaning costs resulting from non-compliant use of the premises.
– Deodorisation costs resulting from a breach of the non-smoking policy.
Article 6 – Cancellation Conditions
All cancellations must be notified in writing to [email protected]. The date of receipt of the email is the date of record.
6.1 Cancellation Policy — Rooms and Château Rental
– Cancellation more than 14 days before the arrival date: no charge — the advance payment is refunded in full.
– Cancellation between 14 and 7 days before the arrival date: 50% of the total stay amount remains due. The advance payment is applied against this amount.
– Cancellation less than 7 days before the arrival date, no-show, or failure to arrive due to circumstances attributable to the guest: 100% of the total stay amount remains due. The advance payment is retained by the establishment; the remaining balance of 50% remains payable and will be recovered by any lawful means.
No refund will be granted for early departure or unconsumed nights, unless expressly agreed in writing by the establishment as an exceptional measure.
6.2 Refunds
Any applicable refunds will be processed within 5 business days to the original payment method.
6.3 Force Majeure
In the event of force majeure within the meaning of Article 1218 of the French Civil Code (an unforeseeable, unavoidable event beyond the control of either party, such as a natural disaster, pandemic, administrative closure or major incident), the parties will seek to agree, where possible, on a postponement of the stay to equivalent dates. If no agreement can be reached, or if performance of the stay becomes permanently impossible, all amounts paid will be refunded, less any services already consumed. No penalty shall apply to either party.
6.4 Cancellation by the Establishment
In the event of cancellation by Château de la Rochetière for a reason other than force majeure (including double-booking or administrative error), the establishment will refund all amounts paid within 5 business days. The guest may additionally seek compensation for proven loss under the applicable provisions of French civil law.
Article 7 – Occupancy, Capacity and House Rules
7.1 Maximum Capacity
The number of occupants must not exceed the number declared at the time of booking, nor the following limits:
– Guest rooms: as specified per room at the time of booking.
– Château rental: strictly 13 persons maximum (adults and children combined), without exception.
Any undeclared excess in occupancy may result in a surcharge of €150 per undeclared person per night, as well as immediate termination of the stay without refund.
7.2 Prohibition of Parties and External Events
The organisation of parties, public gatherings, loud events or any gathering involving persons outside the booking group is prohibited, including during exclusive château rental.
Privatised events (weddings, seminars, celebrations with external guests) are subject to a separate privatisation agreement. Without a signed agreement, no external guests may be accommodated on the premises.
Any breach of this prohibition may result in immediate termination of the stay, without refund or compensation, as well as invoicing of any costs, damages, disturbances or losses incurred. Such amounts may give rise to a total or partial deduction from the security deposit, subject to the provision of supporting documentation or objective evidence.
7.3 Quiet Hours
The peace and tranquillity of the property must be maintained at all times. From 10:00 PM onwards, silence is required throughout the establishment and its grounds, out of respect for other guests and neighbouring residents.
7.4 Care of the Premises and Furnishings
Guests undertake to use all equipment, furniture and installations with care and in accordance with their intended purpose. Any inappropriate use shall engage the guest's liability in accordance with Article 5.
Article 8 – Pets
Pets may be accepted subject to declaration at the time of booking and prior approval from the establishment. The establishment reserves the right to refuse a pet based on its size, behaviour, the number of animals or the nature of the stay.
The presence of a pet entails an additional charge, comprising a daily supplement and, where applicable, an enhanced cleaning fee. Applicable rates are those in force at the time of booking and will be communicated to the guest prior to booking confirmation.
The pet must remain under the constant supervision of its owner and comply with the following conditions:
– Be kept on a lead in all common areas and on the grounds.
– Not be allowed on beds, sofas, armchairs or any other furniture.
– Not cause noise or odour disturbance to other guests.
Any undeclared pet will result in the charge of the applicable supplement. The owner remains solely responsible for any damage, excessive soiling, nuisance or disturbance caused by their pet; any resulting costs may be invoiced in accordance with Article 5.
Article 9 – Non-Smoking Policy
Château de la Rochetière is a fully non-smoking establishment. Smoking of any kind (cigarettes, cigars, e-cigarettes, shisha pipes, etc.) is strictly prohibited in all indoor areas, including guest rooms, bathrooms, corridors, the lounge and all common areas.
Smoking is permitted outdoors, away from windows and doorways, provided it does not disturb other guests and no litter is left behind (cigarette butts, ash, etc.).
Any breach of this policy may result in cleaning, deodorisation and, where necessary, restoration charges, determined in accordance with current rates and the extent of damage identified, without prejudice to a total or partial deduction from the security deposit.
Article 10 – Ancillary Services
10.1 Dinner at the Château
Dinner at Château de la Rochetière is available upon reservation, subject to availability. It is served as a private table per room or per group, according to the arrangement chosen by the establishment. This service is reserved exclusively for guests staying on the premises, unless expressly agreed otherwise, and does not constitute a restaurant service open to the public.
The menu is set by the establishment, taking into account any allergies, intolerances or dietary requirements notified in advance by guests. Guests are required to declare any dietary restrictions or food allergies at the time of booking. In the absence of such prior declaration, the establishment cannot be held responsible for any incident arising from an undisclosed allergen. The establishment complies with allergen information requirements under EU Regulation No. 1169/2011.
Dinner is charged as a supplement and is not included in the price of the stay. Any dinner reservation cancelled less than 48 hours before the meal will be charged at 100% of the amount of the meal booked.
10.2 Spa and Treatments
Access to the spa and massage treatments are ancillary services charged as supplements. Availability and rates are specified at the time of booking or upon request. Use of the spa facilities requires compliance with the hygiene and safety rules displayed on site.
10.3 Electric Vehicle Charging
Electric vehicle charging is a paid ancillary service, subject to availability and the technical specifications of the installation. Applicable rates are communicated by the establishment at the time of booking or upon arrival. Use of the establishment's charging points, sockets or electrical installations without prior agreement is prohibited.
Article 11 – Liability
11.1 Guest Liability
Guests undertake to comply with all rules of the establishment throughout their stay. They are responsible for:
– The cleanliness and condition of the room, the château and all areas used during the stay.
– Any damage caused to the property, furniture or equipment, which will be invoiced in accordance with Article 5.
– The safety of their personal belongings; the establishment accepts no liability for loss, theft or damage.
– Respect for common areas and for other guests staying on the premises.
– Compliance with all applicable safety instructions and proper use of all installations.
11.2 Establishment Liability
Château de la Rochetière undertakes to provide quality services and to make every effort to ensure a pleasant stay. In the event of a problem or complaint, guests are invited to notify the management immediately so that appropriate action may be taken without delay.
The establishment cannot be held liable for incidents or accidents beyond its control, nor for damages caused by guests themselves.
Article 12 – Personal Data Protection
Personal data collected during the booking process (name, contact details, payment information) is processed by SILA Rochetière SAS on the basis of the performance of the accommodation contract (Art. 6(1)(b) GDPR), solely for the purposes of managing the booking, the guest relationship and compliance with legal obligations (guest register, accounting).
For private château rental bookings, the establishment additionally collects a copy of the signing guest's official photo ID and proof of address, solely for identification purposes and to secure the deposit. These documents are retained for the duration necessary to verify the security deposit and are then destroyed, unless a longer retention period is required by law.
Data required for the management of the guest relationship is retained for a maximum period of 3 years from the end of the stay, unless a longer retention period is required by applicable law, in particular in accounting, tax or regulatory matters. Such data is not sold or transferred to third parties, except as required by law.
In accordance with the General Data Protection Regulation (GDPR) and French data protection law, guests have the following rights regarding their data:
– Right of access and rectification.
– Right to erasure (right to be forgotten).
– Right to restriction of processing.
– Right to data portability.
– Right to object to processing.
To exercise any of these rights, guests should submit a request to [email protected]. If a satisfactory response is not received, guests may lodge a complaint with the French data protection authority (CNIL) at www.cnil.fr.
Article 13 – Mediation and Dispute Resolution
In the event of a dispute that cannot be resolved amicably within 60 days of a written complaint from the guest, the guest may refer the matter free of charge to a consumer mediator, in accordance with applicable French consumer law.
The establishment is in the process of joining an accredited consumer mediation scheme. The name and contact details of the competent mediator will be provided to guests upon request at [email protected], once formal membership has been confirmed.
Recourse to mediation is without prejudice to any other legal remedies available to the guest.
Article 14 – General Provisions
14.1 Insurance
The establishment holds the insurance policies required for its activity. Guests are advised to ensure that their personal insurance or travel insurance covers the risks of cancellation, civil liability and property damage during their stay.
14.2 Governing Law and Severability
These Terms are governed by French law. If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Acceptance
By completing a booking at Château de la Rochetière, the guest acknowledges having read, understood and accepted these General Terms and Conditions of Sale in their entirety.
